Subject: Law (Paper-I)

 

Time Allowed: Three Hours

PART-I
(The Civil Procedure Code 1908)

Q No 1 : Discuss the provisions ” Bar to further suit” in the background of Doctrine of Resjudicata. (15 Marks )

Q No 2 : Write a note on Transfer of Decree and the issues to be resolved by the executing Court. (15 Marks )

Q No 3 : Under what circumstances a suit can be withdrawn ? Discuss in detail its consequences including filing of fresh suit. . (15 Marks )

Q No 4 : How can a suit against a minor, a pauper and person of unsound mind be filed ? describe also the procedure for filing of suit by them . (15 Marks )

PART-II
(The Limitation Act 1908)

Q No 5 : Under what circumstances delay in filing of suit or appeal can be condoned. (10 Marks )

Q No 6 : Comment upon the factors considered while computing the period of limitation. (10 Marks )

PART-III
(The Registration Act 1908)

Q No 7 : Discuss the implications of non registration of a document which is otherwise liable to be registered . (10 Marks )

Q No 8 : Describe the nature of documents required to be compulsorily registered under The Registration Act,1908. (10 Marks )

PART-IV
(The Qanoon e Shahadat Order 1984)

Q No 9 : Discuss in detail the doctrine of estoppel & compare estoppel with double jeopardy in Criminal Proceeding. (15 Marks )

Q No 10 : Define and describe burden of proof in civil and criminal proceedings. Illustrate when the onus shifts from one to the other party. (15 Marks )

Q No 11 : Mention the fact which need not to be proved . What are the facts where Court can take judicial notice ? Do the latter require to be proved . (15 Marks )

Q No 2 : What do you understand by alternative defence pleas? How does this differ from estoppel ? Please discuss. (20 Marks)

Q No 3 : Please discuss in detail the kind and nature of punishments provided in the Pakistan Penal Code. Are there any limitation on solitary imprisonment ? Highlight the same. (20 marks )

Q No 4 : Distinguish between :-

i). Common Intention and Common Object (4 Marks )
ii). Qisas and Diyat (4 Marks )
iii). Arsh and Daman (4 Marks )
iv). Theft and Extortion (4 Marks)

Q No 5 : Please discuss jurisdiction of criminal courts provided in the Criminal Procedure Code. Are there limitations on the quantum of sentence these courts can award? (20 Marks)
